YES ON PROP 3

Right to Marry and Repeal Proposition 8 Amendment

ENDORSE-O-METER SAYS: STRONG YES

In 2008, California voters approved Proposition 8, which added language to California’s constitution that reads, “Only marriage between a man and a woman is valid or recognized in California.” Despite being invalidated by the Supreme Court’s decision to legalize same-sex marriage in 2015, Prop 8’s language still exists in the California charter. Prop 3 would erase that language. Because marriage equality is a fundamental civil right that San Francisco politicians and residents have a history of fighting for, we enthusiastically support Prop 3.

The Context

San Francisco is a haven for the LGBTQ community. San Francisco politicians from the late Supervisor Harvey Milk to former Mayor Gavin Newsom have a rich history of standing up for queer rights and marriage equality. This year marked the anniversary of the “Winter of Love,” and San Francisco’s Pride Parade remains one of the largest in the world. As LGBTQ rights are threatened in less liberal parts of the country, it’s important that San Francisco continue to set an example for this fundamental set of values.

This proposition was authored by Assemblymember Evan Low (D-San Jose) and State Senator Scott Wiener (D-San Francisco), who want to ensure that marriage equality is permanently enshrined in the California Constitution and eliminate outdated language from Prop 8. As the US Supreme Court issues increasingly conservative decisions, this amendment would safeguard marriage equality in California against potential future attempts to restrict marriage equality. 

“Although, same-sex marriage is legal, it could be temporary. We have to remain vigilant, unwavering in our dedication to equality,” said Assemblymember Low. “Together, we can reinforce the importance of love, acceptance, and inclusivity. Our journey towards true equality is not over, and this is a foundational step in making progress and change here in the Golden State.”

The Money

Equality California is the major proponent of this measure, putting over $1 million into a committee supporting the passage of Proposition 3.

Support & Opposition

This bill is endorsed by pro-LGBTQ advocacy organizations and state leaders including the Human Rights Campaign, Governor Gavin Newsom, the California Democratic Party, State Superintendent of Instruction Tony Thurmond, Lieutenant Governor Eleni Kounalakis and the Legislative LGBTQ Caucus.

The opposition comes from a number of socially conservative, anti-LGBTQ groups like the Baptist group California Capitol Connection, the California Family Council, and Freedom in Action.
